1. How long does a lawsuit last?
All lawsuits are different, but typically it takes 11 to 14 months except for complex construction matters which may take significantly longer to conclude.
2. How much does a lawsuit cost?
The cost of a lawsuit will typically range from $20,000.00 to $100,000.00 for each party to the case. The overall cost is influenced by several external and internal factors.
3. How long is the average trial?
All trials are different, but typically they last from 2-14 days.
4. I've been sued, can't you just make it go away?
No. The only way to end the lawsuit is to resolve your differences with the person that sued you or go through trial.
5. I didn't do anything wrong, can I just call the other person and try to resolve the dispute?
No. You should never contact the opposition until you have consulted with an attorney. Also, once a person is represented by an attorney, you should refrain from initiating any more direct contact with that person without the express consent of your attorney. If you do contact them, it could actually make the matter worse. Hiring a lawyer is a big step and one that most people do not take lightly. Thus if they've hired a lawyer, it is because the time for directly resolving the problem has passed.
6. I don't understand my bill.
Please carefully read your invoice and if you have questions regarding specific entries please direct it to the attention of the responsible attorney or Misha Kubena.
7. What are the chances that I will win my lawsuit?
Our attorneys cannot guarantee a certain outcome of any legal dispute. Although all cases are different, those with solid evidentiary support tend to be stronger.
8. I've never been in a lawsuit before, what happens after you send the demand letter?
After the demand letter has been sent, it is time to wait and see if the opposition contacts us to try and resolve the dispute. Please note that some claims are governed by statutes that require a 30 or 60 day waiting period after receipt of the demand letter prior to filing suit. If they do not contact us to resolve the problem, then most likely your only remaining remedy will be to file a formal lawsuit.
9. If you are unable to assist me with my legal matter, who can I call?
Lawyer Referral Services of Central Texas at 512-472-8303 and www.austinlrs.com
10. I received a document production request from you, what does this mean?
First, read the entire document. Then go through each question and locate the documents that have been requested and provide them to your attorney. If you put these documents into chronological order, it will help your attorney to better understand the documents and may reduce your bill.
11. Do I really have to go through each of these questions and find these documents?
Yes. Your case will be dramatically strengthened if you have documentary evidence to support your position. Cases that do not have documentary support, tend to be weaker and harder to support.
12. What if I don't have the documents anymore?
If you no longer have the requested document in your physical possession, make a note of that and tell your attorney. He or she may advise you to obtain the document from the person in possession. Every case is different though and this will have to be addressed if it arises.
